Section 3.73 - Executive Order No. 73: Reestablishing the New York State Economic Development Board
I, Hugh L. Carey, by virtue of the authority vested in me by the Constitution and the laws of the State of New York, and as Governor of the State of New York, by Executive Order do hereby reestablish in the Executive Department a board to be known as the New York State Economic Development Board, to act as a cabinet-level economic development advisory group, representative of both management and labor in the private sector.
General Powers and Duties
It is the policy of the State in meeting public needs to establish economic programs, policies, and priorities to achieve sound and balanced economic growth and development, the reduction of chronic unemployment and the establishment of permanent jobs in the private sector.
To assist in carrying out the foregoing policy, the New York State Economic Development Board shall:
- Study and from time to time report to the Governor on existing and potential economic developments, programs, projects and trends in the State;
- Provide a forum for the development of consensus among management and labor to guide the Governor and his cabinet members;
- Undertake economic and fiscal studies which the Governor deems appropriate and desirable;
- Based on these studies, formulate and recommend to the Governor courses of action consistent with sound and balanced state economic development;
- Assist the Governor in the advocacy of those State programs aimed at economic development.
Membership
The New York State Economic Development Board shall consist of such members as may be appointed by the Governor. Such membership shall be selected from the private business and labor communities of this State. The Governor shall designate a chairman and two vice-chairmen.
Rescission of Prior Orders, Effective Date and Transfer Provisions
Executive Order Number 7 dated March 19, 1975, as amended by Executive Order Number 7.1 dated August 25, 1975 and Executive Order Number 7.2 dated February 3, 1976, creating the New York State Economic Development Board, is hereby rescinded effective immediately, On such date, all the functions, powers, duties and obligations possessed by the New York State Economic Development Board created under such Order relating to its duties to oversee and coordinate economic development planning and research activities in the State and to act as the State's economic planning agency pursuant to Public Law 89-136 (Public Works and Economic Development Act of 1965, as amended), and all duties incidental thereto, shall be transferred and assigned to, assumed by and devolved upon the New York State Department of Commerce; and all rights and obligations of the New York State Economic Development Board under any contract or agreement relating to such functions, powers, duties, and obligations to which the New York State Economic Development Board is a party, are hereby transferred and assigned to, devolved upon and assumed by the New York State Department of Commerce. With respect to the functions, powers, duties and obligations so transferred and assumed, the New York State Department of Commerce shall be deemed and be held to constitute the continuation of the New York State Economic Development Board for those purposes and not a different board, agency or authority. Any proceeding or other business or matter heretofore undertaken or commenced by or before the New York State Economic Development Board relative to the functions, powers, duties and obligations herein transferred and assumed by the New York State Department of Commerce may be conducted and completed by the New York State Department of Commerce in the same manner and under the same conditions and with the same effect as if conducted and completed by the New York State Economic Development Board.
With respect to the functions, powers, duties and obligations retained in the New York State Economic Development Board reestablished by this Executive Order, the New York State Economic Development Board shall be deemed and be held to constitute the continuation of such former Board and not a different board, agency or authority. Any proceeding or other business or matter heretofore undertaken or commenced by or before such former New York State Economic Development Board relating to such functions, powers, duties and obligations retained pursuant to this Executive Order may be conducted and completed by the New York State Economic Development Board reestablished by this Executive Order in the same manner and under the same conditions and with the same effect as if conducted and completed by such Board as created pursuant to the Executive Order, as amended, hereinabove referred to.
The members and officers of the New York State Economic Development Board appointed by the Governor pursuant to the Executive Order, as amended, herein rescinded who are in office on the date of this Executive Order shall continue to be members and officers respectively of the New York State Economic Development Board reestablished by this Executive Order without the necessity of reappointment.
All federal funds available to the New York State Economic Development Board for the performance of the functions, powers, duties and obligations transferred and assigned to the New York State Department of Commerce pursuant to this Executive Order, to the extent remaining unexpended or unencumbered, shall be transferred to and made available for use by the New York State Department of Commerce for the same purposes for which originally provided.
