Section 3.12 - Executive order no. 12: establishing health advisory council

There is no higher priority for this administration than providing our citizens with access to quality health care at a price they can afford. To achieve this goal, it is evident that new and innovative policies must be developed in the areas of health care organization, delivery and financing. We must draw upon the very best minds and talents available, both inside and outside of government, and the expertise of many disciplines to solve our immediate problems and develop workable long-range health policies on which to build for the future.

Therefore, I, Hugh L. Carey, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and the Laws of the State of New York, do hereby establish an interdisciplinary health advisory council, to be known as the Health Advisory Council, to act as an advisory council to the Health Planning Commission, as established by Executive Order Number 6, effective March 14, 1975. The Health Advisory Council shall consist of non-governmental representatives from a wide-range of disciplines, professions and backgrounds related to the health field.

I. Powers and Responsibilities

The Health Advisory Council shall:

1. Advise the Governor, through the Health Planning Commission, on health policy matters;

2. Serve as an information gathering and advisory body for the Governor and the Health Planning Commission;

3. Undertake in-depth, interdisciplinary studies related to the organization, delivery and financing of health care services;

4. Develop recommendations for alternative legislative and administrative initiatives to improve the State's health care system;

5. Identify developing and potential problems and issues related to health and health care;

6. Review proposed health legislation to determine its feasibility, impact and consistency with long-range health goals;

7. Concern itself with health issues which involve several departments or agencies of government;

8. Perform such other functions and duties as may be requested by the Governor and/or the Chairman of the Health Planning Commission.

II. Structure and Organization

Members of the Health Advisory Council shall be appointed by the Governor and serve at his pleasure. The Governor shall appoint co-chairmen, who shall be empowered to organize the membership into organizational study units deemed necessary to effectively exercise the responsibilities of the Council.

Members of the Council will receive no compensation for their services as members, but shall be allowed their actual and necessary expenses incurred in the performance of their duties within the amount available therefor.

III. Health Planning Advisory Council

The Health Planning Advisory Council, as established by Executive Order Number 6, is hereby continued to advise the Health Planning Commission in the exercise of its powers, functions and duties relating to the National Health Planning Resources Act of 1974 and any other act relating to comprehensive health planning.
