Section 3.111 - Executive order no. 111: establishing a management advisory council and an employee relations advisory council

I. HUGH L. CAREY, Governor of the State of New York by virtue of the authority vested in me by the Constitution and Laws of the State of New York, in order to promote harmonious working relationships between the State of New York as an employer, and its employees, hereby establish a Management Advisory Council and an Employee Relations Advisory Council to advise the Director of Employee Relations in the development and implementation of employee programs.
There is hereby created a Management Advisory Council to provide the Director of Employee Relations with advice concerning the needs of those State employees whose positions are designated managerial or confidential pursuant to article 14 of the Civil Service Law. Such advice should encompass, but not be limited to, management and career development and training, compensation and benefits, quality of working life, and the establishment of viable mechanisms for the exchange of ideas.
There is hereby created an Employee Relations Advisory Council to provide the Director of Employee Relations with advice in determining, promoting and implementing the employee relations policy of the State. The Employee Relations Council shall also provide advice concerning development of methods for improved communications with State departments, agencies, offices and bureaus.
The director of Employee Relations shall designate, from among employees in departments, agencies, offices and bureaus of the State whose positions are designated managerial or confidential, 15 individuals to function as members of the Management Advisory Council, and eight individuals to function as members of the Employee Relations Advis-ory Council. Members of the Management Advisory Council shall be designated after solicitation of recommendations from heads of departments, agencies, bureaus and offices.
The members of each Council shall elect from among themselves a chairman and a secretary. Each such Council shall also have a nonvoting member, to be assigned by the Director, who shall be a member of the staff of the Governor's Office of Employee Relations. The term of office of Council members shall be for three years, ending on June 30th of the third year. Initial appointments may be for staggered terms of one, two or three years, to ensure continuity of membership. A vacancy shall be created upon a member's resignation, termination of a member as a State employee or a change in a member's employment designation. Any vacancy on a Council during a term shall be filled for the balance of that term by the Director of Employee Relations. At the expiration of each term, the Director of Employee Relations shall designate successors from among the employees in departments, agencies, bureaus and offices of the State whose positions are designated managerial or confidential in the same manner as original designations were made.
Each Council shall meet as necessary, and shall maintain a written record of its meetings. Each Council shall also establish bylaws which shall govern its activities, consistent with this order and the authority of the Director pursuant to sections 652, 653 and 654 of the Executive Law. Each set of bylaws shall take effect upon the filing with and approval of the Director of Employee Relations.
