Section 2.4 - Executive Order No. 4: Amending Executive Order No. 42, dated October 14, 1970, relating to the procedures for submission and settlement of certain grievances of state employees

I, Malcolm Wilson, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby direct by executive order that paragraph (a) of section six of Executive Order Number 42 [§ 1.42, supra], dated October 14, 1970, be amended to read as follows:

(a) The provisions of this order shall apply to employees in the executive branch of the State government:

(1) who are not covered by a collective agreement between the State and a certified or recognized employee organization; or

(2) who are covered by a collective agreement which accords such employees the right to continue to process grievances under this order, except that where the provisions of such agreement conflict with the provisions of this order or with the provisions of any regulation promulgated by the Grievance Appeals Board pursuant to this order with respect to the processing of grievances under this order, the provisions of such agreement shall control.
