Section 1.6 - Executive order no. 6: relating to a program for improved safety for state employees driving state-owned passenger cars

The safe operation of State-owned automobiles is an important responsibility. Drivers of such cars are responsible not only to the State, as their employer, but also to the general public. Their conduct on the highway should set an example of good driving habits and skills for all drivers. The State's responsibility in this area has been recognized by the Interdepartmental Committee on Traffic Safety which recommended the establishment of a traffic safety program for State employees.

I, Nelson A. Rockefeller, by virtue of the authority vested in me by the Constitution and laws of the State of New York, and as Governor of the State of New York, do hereby direct by Executive order that the following uniform plan of action be instituted throughout the Executive Branch of State Government, excluding the Division of State Police which operates under its own approved plan, in order to improve the safe driving habits and skills of State-employed drivers, and contribute to the general safety of all our citizens.

A. Vehicle Maintenance and Inspection

The Office of General Services, in conjunction with the Department of Motor Vehicles, shall set standards for maintenance and inspection of all State-owned passenger cars. Inspections shall be made under the over-all supervision of the Office of General Services, using the facilities of the Office of General Services, the Department of Public Works, and such other available facilities as may be necessary.

The Office of General Services shall promulgate such regulations and prepare such forms as may be necessary to make effective its standards for maintenance and inspection.

B. Driver Improvement

Every State chauffeur operating a State-owned passenger vehicle, or other State employee whose duties include acting as such a chauffeur as part of his regular assignment, shall attend a period of driver improvement instruction to be conducted by the Department of Motor Vehicles. In addition, any State employee, regardless of job classification, involved after May 31, 1961 in an operating accident reportable under Section 605 of the Vehicle and Traffic Law, while driving a State-owned passenger vehicle shall attend such a period of driver improvement instruction. Each agency head shall be responsible for the attendance of such employees at such periods of instruction. The Department of Motor Vehicles shall report on the activities and results of such periods of instruction to the Accident Review Committee, as hereinafter described.

C. Agency Accident Review Officer

The head of each State department or agency shall designate, from among his deputies or other assistants having similar responsibility, an agency accident review officer. Where one such officer could not effectively perform the functions hereinafter described throughout a department or agency, one or more additional accident review officers of similar rank may be designated.

Each such accident review officer, with the assistance of the safety administrator in each department or agency, shall:

a. within two weeks of an operating accident reportable under Section 605 of the Vehicle and Traffic Law occurring after May 31, 1961 involving an agency employee driving a State-owned passenger vehicle and causing property damage or bodily injury:

obtain all records relating to the driving experience of the employee, and to the specific accident occurrence; and

transmit the information so obtained to the Accident Review Committee as hereinafter described and to the head of the department or agency who shall arrange for the attendance of all agency drivers involved in such accidents at a period of driver improvement instruction conducted by the Department of Motor Vehicles.

b. sponsor and conduct motor vehicle accident prevention activities for department or agency employees, where such activities are not the responsibility of an organized safety unit within the department or agency.

c. report to and advise the department or agency head regarding (1) the motor vehicle accident record of the department or agency and (2) the motor vehicle accident prevention activities of the department or agency.

The safety administrator of each department of agency shall attend an orientation course in accident causation and prevention, conducted by the Department of Civil Service.

D. Accident Review Committee

The Accident Review Committee shall consist of representatives of the following departments or agencies, to be appointed by their respective department or agency heads, and such additional persons as may be designated by the Committee Chairman:

Office of General Services, Chairman

Department of Motor Vehicles

Department of Civil Service

Department of Health

Department of Public Works

The Accident Review Committee shall:

a. review information relating to State employee motor vehicle accidents received from department or agency accident review officers and forward such information to the Division of Research and Development of the Department of Motor Vehicles for research purposes and statistical analysis.

b. review reports of such research and statistical analysis and of driver improvement activity conducted by the Department of Motor Vehicles, and forward information thereon to department or agency heads.

c. coordinate, where necessary, and facilitate inter-agency employee traffic accident prevention activities.

d. report to and advise responsible authorities regarding (1) the motor vehicle accident record of State employees and (2) the employee motor vehicle accident prevention activities of the Executive Branch of State government.

e. perform such other functions and activities as may be assigned to it in the interest of State employee traffic safety.

E. Recognition for Safe Driving Records

Each department or agency accident review officer shall designate to the Accident Review Committee individuals within the department or agency who merit special recognition for their safe driving records as State employees, based upon standards of performance promulgated by the Accident Review Committee. From among the individuals so designated, the Committee shall choose those who, in its judgment, most merit such special recognition. The nature of such recognition shall be determined by the Committee.
