Section 1.52 - Executive order no. 52: amending and superseding the executive order of april 2, 1971 [no. 50], creating the manpower resources commission

I, Nelson A. Rockefeller, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and the Laws of the State of New York, do hereby direct by Executive Order that Executive Order No. 50 dated April 2, 1971, which established the Manpower Resources Commission, be amended to read as follows:

I, Nelson A. Rockefeller, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby establish in the Executive Department a Manpower Resources Commission to provide centralized leadership and direction in manpower training, to consist of the Industrial Commissioner as chairman, the Commissioners of Education, Commerce, Environmental Conservation, Correctional Services, Social Services, Local Government, and Human Rights, the President of the State Civil Service Commission, the President of the State University, and the Director of the Division for Youth.

I. General Powers

The Commission shall have primary responsibility for the coordination of manpower planning and administration within the State. In fulfillment of this responsibility, the Commission shall have, but not be limited to, the following powers and duties:

--to study, document, review and evaluate on a continuing basis, job training and development activities among governmental and non-governmental agencies in the State;

-- to develop and recommend to the Governor a comprehensive manpower policy, setting forth program and funding priorities and assignments of responsibility to participating State agencies;

--to take inventory of State manpower needs and the economic program and physical resources available to meet them;

-- to develop an information and reporting system which will aid in the evaluation of manpower training programs and their effectiveness with particular concern for their impact on minority groups and the disadvantaged;

-- to prepare in advance of the various agency budget submissions and submit annually to the Governor a recommended State manpower fiscal program setting forth the overall goals of the Commission and the resources available from all sources to meet them; and

-- to coordinate and take steps to improve the administration of State agency and inter-agency manpower programs and activities, through such mechanisms as it may deem necessary or desirable, including the appointment of working committees which may include persons not members of the Commission and persons employed by agencies not represented on the Commission.

To assure the necessary coordination between Federally financed manpower training programs and those of the State, the Commission members, by virtue of their office, shall serve as the agency representatives to the State Manpower Planning Council. The Chairman of the Commission shall serve, ex officio, as Chairman of the State Manpower Planning Council.

II. Personal and Other Support Services

The Department of Labor shall provide all such personal and other services as may be necessary or desirable to assist the Manpower Resources Commission to fulfill the puprposes of this Order.

III. Effective Date

Executive Order No. 50, dated April 2, 1971, is hereby amended and superseded by this Executive Order, effective December 22, 1971. On such date, all rights and obligations of the Office of Planning Services under any contract or agreement relating to functions, powers and duties transferred by this Order to the Department of Labor are hereby transferred and assigned to, devolved upon and assumed by the Department of Labor. With respect to the functions, powers, duties, rights and obligations so transferred and assumed, the Department of Labor shall be deemed and held to constitute the continuation of the Manpower Resources Commission and not a different agency or authority. Any proceeding or other business or matter heretofore undertaken or commenced by or before such Commission may be conducted and completed by the Department of Labor in the same manner and under the same terms and conditions and with the same effect as if conducted and completed by such Commission.

Provisions may be made, within appropriations available therefor and subject to the Civil Service Law, for the transfer to the Department of Labor of such officers and employees of the Office of Planning Services other than Commission members as the Industrial Commissioner may deem necessary.

All appropriations or reappropriations together with any Federal funds advanced to the Office of Planning Services, to the extent of remaining unexpended or unencumbered balances thereof, whether allocated or unallocated and whether obligated or unobligated, shall be transferred to and made available for use by the Department of Labor for the same purposes for which originally appropriated or advanced.
