By virtue of the authority vested in me as Governor of the State of New York, and in order to promote in this State the achievement of uniform, high-quality medical care available to everyone, regardless of race, age, national origin or economic standing, I, Nelson A. Rockefeller, do hereby establish the following responsibilities of State departments concerning the implementation of Title XIX of the Federal Social Security Act:

1. The Department of Social Welfare shall be responsible for preparing the State Plan required under Title XIX, and shall be the State agency for supervising the administration of the Plan.

2. The Department of Health shall be responsible for establishing, maintaining and certifying to the Department of Social Welfare standards for all institutional and non-institutional care and services under the State Plan.

3. In addition to the responsibilities of the Department of Social Welfare in supervising the administration of the Plan, the Department of Health, consistent with its responsibilities under State law, shall be independently responsible for

reviewing and certifying local public welfare medical plans to assure that the quality of medical services is in the best interest of the recipients, and

reviewing and auditing the quality and availability of medical care rendered under local public welfare medical plans.

4. The Department of Social Welfare and the Department of Health shall enter into cooperative arrangements with each other and, if necessary, with the Department of Education, Division of Vocational Rehabilitation, concerning the implementation of Title XIX.
