Section 2408.7 - Academic requirements; program pursuit and academic progress

(a) Program pursuit. Except as provided for in subdivision (d) of this section, a student shall be deemed to be pursuing the approved program of study in which the student is enrolled if:

(1) during each term of study in the first year for which an award is being received, the student receives a passing or failing grade in at least one-half of the minimum amount of study required to constitute full-time study as defined in sections 2400.2 and 2408.6 of this Title; or

(2) during each term of study in the second year for which an award is being received, the student receives a passing or failing grade in at least three-fourths of the minimum amount of study required to constitute full-time study as defined in section 2400.2 of this Title; or

(3) during each subsequent term of study for which an award is being received, the student receives a passing or failing grade in no less than the minimum amount of study required to constitute full-time study as defined in section 2400.2 of this Title.

(b) Satisfactory academic progress. Except as provided for in subdivision (d) of this section, to determine whether a student receiving an award is making satisfactory progress toward the successful completion of his or her program's academic requirements, each institution shall follow the standard of satisfactory academic progress, which includes required levels of achievement to be measured at stated intervals, set forth in paragraph c of subdivision 6 of section 665 of the Education Law.

(c) Full-time academic study requirements. Full-time students shall maintain good academic standing by complying with the following requirements:

(1) Loss of good academic standing shall be determined at the end of each term of the regular academic year, and shall mean that a student has:
(i) failed to pursue the program of study in which he or she is enrolled, as determined pursuant to subdivision (a) of this section; and/or

(ii) failed to make satisfactory progress toward the completion of his or her program's academic requirements, as determined by subdivision (b) of this section.

(2) If a student is determined to have lost good academic standing by failing to meet the conditions established in subparagraphs (1)(i) and (ii) of this subdivision, further payments of an award shall be suspended until the student is restored to good academic standing. A student who loses eligibility for an award pursuant to this subdivision, can regain eligibility as follows:
(i) make up the deficiency without benefit of State financial assistance;

(ii) be eligible for and granted a one-time waiver;

(iii) stay out of school for one calendar year; or

(iv) transfer to and be accepted at another educational institution; or

(v) establishing in some other way, to the satisfaction of the president, evidence of his or her ability to successfully complete an approved program.

(d) The provisions of subdivisions (a) and (b) of this section may be waived once for an undergraduate student if an educational institution certifies, and maintains documentation, that such waiver is in the best interest of the student. Prior approval by the president of the criteria and procedures used by an educational institution to consider and grant waivers shall not be required. The president may review such criteria and procedures in use, and require an educational institution to review those found to be not acceptable.

(e) The corporation shall periodically provide each educational institution with a list of registered programs approved by, or on behalf of, the corporation for purposes of tuition assistance program awards in that institution, and such institution shall certify as attending approved programs of study only those students enrolled in programs included in such list, except as otherwise specifically authorized by, or on behalf of, the corporation because of administrative error, pending registration, or other special circumstances.
