Section 2408.4 - Exclusion of income of parent or spouse

In calculating the amount of an award for applicants who are not financially independent of their parents, the income of a parent and spouse shall be entirely excluded from consideration if, prior to January 1st preceding the academic year for which an application is made:

(a) the parent or spouse was deceased;

(b) the applicant and spouse were divorced or separated; and

(c) the parents of the applicant were divorced or separated, in which case the income of the parent having custody or with whom the applicant resides shall be included and any payments made for the support of the applicant by the parent not having custody or with whom the applicant does not reside shall be included.
