Part 2201 - General Eligibility Criteria
Section 2201.4 - Eligibility criteria for vietnam veterans' children born with spina bifida

(a) Awards shall be available to applicants who fulfill the eligibility requirements set forth in section 2201.1 of this Part and, in addition, fulfill the eligibility criteria set forth in this section.

(b) All applicants must:

(1) have been born to a Vietnam Veteran. Vietnam Veteran, shall mean a person who served in Indochina at any time from December 22, 1961 to and including May 7, 1975, and was honorably discharged from the Armed Forces of the United States.

(2) have been born with Spina Bifida, which shall mean a diagnosis at birth of such disease inclusive of all forms, manifestations, complications and associated medical conditions thereof, but shall not mean Spina Bifida Occulta. Such diagnosis shall have been made in accordance with the provisions of the Federal Spina Bifida program and documented by the United States Administration of Veterans' Affairs;

(3) be matriculated in an approved undergraduate or graduate program at a degree granting institution.

(c) Every recipient shall receive an annual award of $450.

(d) Recipients matriculated in an approved undergraduate program shall be entitled to receive an annual award for not more than four academic years of undergraduate study or five academic years if a program normally requires five years, as defined by the Commissioner of Education pursuant to article 13 of the Education Law.

(e) Recipients matriculated in an approved graduate program shall be entitled to receive an annual award for not more than three academic years of study.

(f) Application for an award shall be submitted on such form and with such documentation as the president may require.
