Section 210.9 - Reimbursement for taxes, rents, levies and charges paid by the dislocated person or other entity to a taxing entity

Application for payment of moving expenses shall be made to the commissioner upon forms prescribed by the commissioner and shall be accompanied by such information and evidence as he may require and payment of such will be made to eligible persons under the circumstances to the extent set forth below:

(a) Requirement for reimbursements for taxes, rents, levies and charges paid by

(1) The amount be separately computed and stated, and

(2) The amount should represent the pro rata portion of these taxes, rents or charges actually paid to a taxing entity, and

(3) The taxes, rents or charges have become a lien on the property prior to the date of acquisition pursuant to the Education Law, and

(4) These taxes, rents or charges were allocable to a period subsequent to the date of vesting or title or the effective date of the possession of such property by the State, whichever occurred earlier.

(b) Application for reimbursement.

(1) Application for reimbursement for such taxes, rents, levies or charges shall be made within six months of completion of the move.
