Section 187.6 - Appeals

(a) Appeals shall be directed to the commissioner on forms prescribed by him, copies of which are available at the offices of the records access officer and of the person in charge of each office located outside the City of Albany.

(b) All such appeals shall be delivered to the records access officer, or to the person in charge of an office outside the City of Albany, within 30 days after the denial from which such appeal is taken.

(c) Appeals will be determined by the commissioner or his authorized representative.

(d) Notice of a determination denying an appeal by a data subject relating to the amendment of or the correction of a department record shall include notice to the data subject of the right to file a statement of disagreement with the disputed record, as provided in Public Officers Law, section 95(4).
