Section 175.11 - Attendance in public school programs for certain pupils with disabilities

(a) For the purpose of the apportionment of State aid to school districts pursuant to section 3602 and subdivision 3 of section 4405 of the Education Law, the attendance of such pupils shall be calculated in the manner set forth in section 175.6 of this Part.

(b) For the purpose of determining weighted pupils with disabilities pursuant to paragraph (i) of subdivision 1 of section 3602 of the Education Law and notwithstanding any other provision of this Part, the following definitions shall apply:

(1) Twenty percent of the week means not less than five hours each week at the elementary level and not less than 51/2 hours each week at the secondary level.

(2) Sixty percent of the school day means a minimum of three hours each school day of each school week at the elementary level, or a minimum of 31/2 hours each school day of each school week at the secondary level.

(3) Multi-level middle school program means a program provided in a public middle school that consists of one or more grades below grade 7 and one or more of grades 7 through 9.
