Section 174.5 - Computation of the direct cost of educational services provided to homeless children pursuant to section 3202(8) of the education law and section 100.2(x) of this title

For purposes of reimbursement pursuant to section 3202 (a)(8) of the Education Law, the direct costs of educational services provided to a homeless child for whom the school district of current location, as defined in section 100.2(x)(1)(iii) of this Title, or a school district participating in an approved regional placement plan is designated as the district of attendance shall be calculated in accordance with this section.

(a) The direct cost of educational services provided by such a school district for each such homeless child attending upon instruction for the school year shall be computed as follows:

(1) The cost of instruction of pupils in each category of pupils, computed in accordance with section 174.2(a)(1)-(2) of this Part, shall be divided by the estimated average daily attendance of pupils in each category, including the estimated full-time equivalent attendance of those children attending upon instruction pursuant to section 3202 (5) and (8) of the Education Law.

(2) Such direct cost of educational services shall upon the conclusion of the school year be audited against actual revenues, expenditures and average daily attendance, including the actual full-time equivalent attendance of those children attending upon instruction pursuant to section 3202 (5) and (8) of the Education Law.

(b) The direct cost of educational services provided by such a school district for each such homeless child attending upon instruction for less than the school year shall be computed by multiplying the direct cost of educational services as computed in subdivision (a) of this section by the full-time equivalent attendance of such child as computed pursuant to section 175.6 of this Title.
