Section 169.3 - Approval of grants

(a) Grants for employer specific training, pursuant to Education Law, section 3032(4), and additional grants for employer specific training pursuant to Education Law, section 3032(5), may be awarded for a project which provides for:

(1) training programs for a business or industry which intends to locate in New York State; or

(2) training programs for a business or industry located in New York State which is expanding its current operations; or

(3) training programs to help a business or industry located in New York State remain in the State; or

(4) retraining and upgrading for personnel in a business or industry located in New York State to help such personnel keep pace with technological innovations or other changes in the economy; or

(5) training programs for individuals to promote the successful management and/or operation of a business purchased by such individuals to provide for their continued employment through the formation of a worker-owned cooperative or an employee stock ownership plan.

(b) The commissioner will appoint within each region of the State a coordinating committee consisting of representatives of educational institutions, business and labor, and such other individuals as the commissioner may appoint. The committee shall make recommendations to the commissioner on each project submitted by a local education agency located within such committee's region.

(c) Applications shall be on a form prescribed by the commissioner and may be submitted by a local education agency at any time during the fiscal year.

(d) If any funds allocated to a region for grants pursuant to subdivision 4 of section 3032 of the Education Law are not committed for the purposes of such subdivision by November 15th, the commissioner may reallocate some or all of such funds to projects in other regions of the State in accordance with the provisions of this Part.

(e) If any funds allocated to a region for grants pursuant to subdivision 5 of section 3032 of the Education Law are not committed for the purposes of such subdivision by March first, or are committed prior to March first and are subsequently found to be unnecessary for expenditure to meet existing contractual obligations, the commissioner shall reallocate such funds to projects in other regions of the State in accordance with such subdivision.

(f) Not less than 20 percent of the funds allocated to a region for purposes of Education Law, section 3032(5) shall be available for training programs which will provide placements for persons who are economically disadvantaged or dislocated workers.
