Section 166.5 - Allocation and use of funds

(a) Eligible agencies whose applications have been approved shall be eligible for an allocation of funds under this Part.

(b) An eligible agency may use the funds to:

(1) operate and administer a basic skills educational, English-as-a-second-language, high school equivalency preparation, or job-related literacy program for employees of public or private employers who are represented by labor organizations which operate or participate in the operation of the program or for members of such labor organizations;

(2) provide counseling or support services or develop new curricula for such workplace literacy programs;

(3) enter into a consortium with organizations of employers to operate a workplace literacy program; and/or

(4) contract with an approved not-for-profit educational agency to provide workplace literacy instruction.

(c) Payment of all or any part of a grant may be suspended or terminated by the commissioner, if an eligible agency fails to comply with the provisions of the Education Law, with this Part, or with any other applicable law or regulation; or if he finds that the program is not being implemented or administered in a satisfactory manner or is failing substantially to effectuate the purpose of the grant.

(d) Nothing in this Part shall be construed to prevent the use of funds obtained from other sources in the planning, execution or evaluation of programs.
