Part 116 - Educational Programs And Services For Children In Full-time Residential Care In Homes Or Facilities Operated Or Supervised By A State Department Or Agency Or Political Subdivision
Section 116.1 - Scope of part

(a) Any State department or agency or political subdivision, except a board of education or a board of cooperative educational services, which provides educational programs and services for children who are in full-time residential care in homes or facilities operated or supervised by such agencies, and who do not attend the public schools of the school districts in which such homes or facilities are located, shall provide such programs and services in accordance with the requirements of sections 116.2, 116.5, 116.6 and either section 116.3 or 116.4 of this Part. Prior approval of the commissioner is required to provide educational programs and services pursuant to the provisions of section 116.4 in lieu of the provisions of section 116.3 of this Part.

(b) The educational programs and services conducted or supervised by a State department, agency or political subdivision, pursuant to this Part, shall be subject to review by the Commissioner of Education.
