(a)
Requirements for the extension in bilingual education.
The candidate shall meet the requirements in each of the
following paragraphs:
(1) The
requirements of this subdivision shall be applicable to the extension in
bilingual education of provisional, permanent, initial, emergency COVID-19, or
professional certificates in the classroom teaching service and provisional,
permanent, initial, or professional certificates in the school counselor title.
The requirements of section
80-2.9 of this Part shall be
applicable to the extension in bilingual education for certificates in the
pupil personnel service, other than certificates in the school counselor title,
or the administrative and supervisory service.
(2) The candidate shall meet the requirements
in each of the following subparagraphs:
(i)
Education.
(a) For candidates who are
requesting the extension of a certificate in a title in the classroom teaching
service other than school media specialist (library), library media specialist,
school media specialist (educational communications), or educational technology
specialist; the candidate shall satisfactorily complete a program registered
pursuant to section
52.21(b)(4)(i) of
this Title, or its equivalent consisting of a total of 12 semester hours of
coursework. Such equivalent coursework shall include study in each of the
following subjects:
(1) theories of bilingual
education and multicultural perspectives;
(2) sociolinguistics and psycholinguistics;
and
(3) methods of teaching English
language arts and home language arts to bilingual English language learners
using the home language and English;
(4) methods of teaching other content to
bilingual English language learners using the home language and
English.
(b) For
candidates who are requesting the extension of a certificate in school media
specialist (library), library media specialist, school media specialist
(educational communications), or educational technology specialist, the
candidate shall satisfactorily complete a program registered pursuant to
section 52.21(b)(4)(ii) of
this Title, or its equivalent consisting of a total of six semester hours of
coursework. Such equivalent coursework shall include study in each of the
following subjects:
(1) theories of bilingual
education and multicultural perspectives; and
(2) methods of providing library media
services or educational technology services, as appropriate to the teaching
certificate, to English language learners using the home language and
English.
(c) For
candidates who are requesting the extension of a certificate in the school
counselor title, the candidate shall satisfactorily complete a program
registered pursuant to section
52.21(b)(4)(ii) of
this Title, or its equivalent consisting of a total of fifteen semester hours
of coursework. Such equivalent coursework shall include study in each of the
following subjects:
(1) theories of bilingual
education and multicultural perspectives; and
(2) methods of providing school counselor
services to English language learners using the home language and
English.
(ii)
Examination. The candidate shall submit evidence of having achieved a
satisfactory level of performance on the New York State Teacher Certification
Examination bilingual extension assessment.
(3) Interim bilingual education extension for
certificates in speech and language disabilities or for teaching for speech-
and hearing-handicapped.
(i) An interim
bilingual education extension may be issued to holders of certificates in
speech and language disabilities or teaching the speech- and
hearing-handicapped in the classroom teaching service who have demonstrated
proficiency in a language other than English. The interim bilingual education
extension shall be valid for three years from its effective date and shall not
be renewable, except the time validity of a bilingual education extension may
be extended for holders called to active duty in the Armed Forces for the time
of active service and an additional 12 months from the end of such service. No
interim bilingual extension shall be issued with an effective date that begins
after September 1, 2010.
(ii) To be
eligible for an interim bilingual education extension, a candidate must meet
the following requirements:
(a) hold an
initial or professional certificate in speech and language disabilities or a
provisional or permanent certificate for teaching the speech- or
hearing-handicapped; and
(b) be
matriculated in a registered program leading to a bilingual education extension
of a certificate as a teacher in the classroom teaching service, as prescribed
in section 52.21(b)(4)(i) of
this Title, provided that such program must require the candidate to pass an
assessment of proficiency in the language of the bilingual education extension
sought as a condition for entry into the program.
(4) Supplementary bilingual education
extension for certificates in the classroom teaching service and the school
counselor title.
(i) Purpose. The purpose of
a supplementary bilingual education extension is to authorize a teacher who is
currently certified in a title in the classroom teaching service to teach
bilingual English language learners and to authorize a certified school
counselor to work with bilingual English language learners, where there is a
demonstrated shortage, while the candidate is matriculated in a program at an
institution of higher education leading to an extension in bilingual education
or to provide necessary supports to recently arrived and asylum-seeking
students.
(ii) Limitations. The
supplementary bilingual extension shall be valid for three years from its
effective date and shall not be renewable, provided that such extension may be
renewed one time for a period of three years from effective date of the renewal
if the candidate obtained the first extension by submitting evidence of having
achieved a satisfactory level of performance on the bilingual education
assessment pursuant to subparagraph (iv) of this paragraph, is matriculated in
a registered program leading to a bilingual education extension, and completed
the coursework and employer statement requirements as prescribed in clauses (c)
and (d) of subparagraph (iii) of this section. A supplementary bilingual
education extension shall also be limited to employment with an employing
entity.
(iii) Requirements. To be
eligible for a supplementary bilingual education extension, a candidate shall
meet the following requirements:
(a)
Application. The candidate shall apply for the supplementary bilingual
education extension and upon application qualify for the supplementary
bilingual education extension.
(b)
Certification. The candidate shall hold a valid provisional, initial, emergency
COVID-19, permanent, or professional certificate in a title in the classroom
teaching service or a valid provisional, initial, permanent, or professional
certificate in the school counselor title identified in this Part.
(c) The candidate shall be matriculated in a
registered program leading to a bilingual education extension, as prescribed in
section 52.21(b)(4) of
this Title, provided that such program must require the candidate to pass an
assessment of proficiency in the language of the bilingual education extension
sought as a condition for entry into the program, or unless otherwise
prescribed in subparagraph (iv) of this paragraph.
(d) Education. The candidate shall have
completed coursework as prescribed in this subparagraph.
(1) The candidate shall have completed three
semester hours in bilingual education as prescribed in the requirements for a
bilingual education extension, set forth in this section, including study in
theories of bilingual education and multicultural perspectives unless otherwise
prescribed in subparagraph (iv) of this paragraph.
(2) A statement shall be submitted by the
chancellor, in the case of employment with the City School District of the City
of New York; or by the superintendent, in the case of other employing boards;
or by the chief school officer, in the case of employment with another entity
required by law to employ certified teachers or school counselors certifying:
(i) the employing entity seeks to employ the
candidate in a position in a certificate title in the classroom teaching
service or in the school counselor certificate title with a demonstrated
shortage of certified teachers or certified school counselors with an extension
in bilingual education;
(ii) the
employing entity will require, as a condition of employment under the
supplementary condition bilingual extension, the candidate's matriculation in a
program at an institution of higher education leading to a bilingual extension
unless otherwise prescribed in subparagraph (iv) of this paragraph;
and
(iii) the employing entity will
provide appropriate support to the candidate undertaking an assignment with the
supplementary bilingual education extension to ensure the maintenance of
quality instruction for such candidate.
(iv) For candidates who apply for a
supplementary bilingual education extension in the classroom teaching service
and in the school counselor title between September 12, 2023, and August 31,
2024, in order to provide necessary supports to recently arrived and
asylum-seeking students, the candidate may submit evidence of having achieved a
satisfactory level of performance on the bilingual education assessment, if
available, in lieu of matriculating in a registered program leading to a
bilingual education extension and completing coursework as prescribed in
clauses (c) and (d) of subparagraph (iii) of this
section.
(b)
Requirements for the extension to teach a subject in grades 5-6.
The candidate shall meet the requirements in each of the
following paragraphs:
(1) The
candidate shall hold a valid permanent, initial, emergency COVID-19, or
professional certificate in English language arts (7-12), world language other
than English (7-12), mathematics (7-12), biology (7-12), chemistry (7-12),
earth science (712), physics (7-12), social studies (7-12), or in any specific
career and technical education subject (7-12).
(2) The candidate shall satisfactorily
complete a program registered pursuant to section
52.21(b)(4)(iii)
of this Title, or its equivalent consisting of six semester hours of coursework
in middle childhood education which shall include study in early adolescent
development and instructional strategies in middle childhood
education.
(c)
Requirements for the extension to teach a subject in grades 7-9.
The candidate shall meet the requirements in each of the
following paragraphs:
(1) The
candidate shall hold a valid initial or professional certificate in childhood
education (grades 1 through 6) or a valid provisional or permanent certificate
for teaching common branch subjects in the lower (PreK-3) and upper (4-6)
elementary grades (PreK-6).
(2) The
candidate shall satisfactorily complete a program registered pursuant to
section 52.21(b)(4)(iv) of
this Title, or its equivalent consisting of 30 semester hours in coursework in
the subject to be taught and six semester hours of coursework in middle
childhood education which shall include study in early adolescent development
and instructional strategies in middle childhood education.
(3) The candidate shall complete the New York
State Teacher Certification Examination content specialty test in the subject
for which a certificate extension is being sought.
(d)
Requirements for the extension for
gifted education.
(1) Effective
September 1, 2006, this extension shall authorize the candidate to provide
education for gifted pupils, as such term is defined in section 4452 of the
Education Law, within a gifted and talented program which is funded pursuant to
the Education Law and in accordance with Part 142 of this Title.
(2) The candidate shall meet the requirements
in each of the following subparagraphs:
(i)
The candidate shall hold a valid provisional, permanent, initial, or
professional certificate in the classroom teaching service.
(ii) The candidate shall complete a program
registered pursuant to section
52.21(b)(4)(v) of
this Title, or its equivalent consisting of a total of 12 semester hours of
coursework that includes study in each of the following subjects: knowledge of
the characteristics of gifted students who learn at a pace and level that is
significantly different from their classmates; knowledge of various tools and
methods for identifying and assessing gifted students, and skill in using such
tools and methods; knowledge and understanding of appropriate curriculum design
for gifted students; knowledge and skills for planning, providing,
coordinating, and evaluating differentiated teaching and learning environments
to challenge and assist gifted students in learning to their highest level; and
skills for collaborating with other school staff, families, and the community
to provide appropriate individualized instruction for gifted
students.
(iii) The candidate shall
complete the New York State Teacher Certification Examination content specialty
test in gifted education.
(3) Statement of continued eligibility.
(i) A person employed in a position in New
York State as a teacher within a gifted and talented program which is funded
pursuant to the Education Law and in accordance with Part 142 of this Title for
three years in the period between September 1, 1998 and August 31, 2006, may be
issued a statement of continued eligibility pursuant to which such person may
continue to teach in such a program without the extension prescribed in this
subdivision, provided such person holds a permanent or professional certificate
in the classroom teaching service.
(ii) A statement of continued eligibility
shall be limited to the specific permanent or professional certificate held
authorizing classroom teaching service, as prescribed in subparagraph (i) of
this paragraph, but shall be valid for service in any school
district.
(iii) Applications for
the statement of continued eligibility must be filed with the department on or
before September 1, 2008.
(e)
Requirement for the extension in
coordinator of work-based learning programs.
(1) The extension shall authorize the
candidate to coordinate work-based learning programs, such as programs
providing extended shadowing experiences, the General Education Work Experience
and Career Exploration Program (GEWEP), the Cooperative Career and Technical
Education Work Experience Program (CO-OP), the Career Exploration Internship
Program (CEIP), and internship and youth apprenticeship/pre-apprenticeship
programs; provided that CO-OP and youth apprenticeship/pre-apprenticeship
programs shall be supervised in coordination with a teacher certified in the
content area in which the placement takes place.
(2) The candidate shall meet the requirements
in each of the following subparagraphs:
(i)
The candidate shall hold a valid permanent, initial, emergency COVID-19, or
professional certificate in the classroom teaching service in any title at the
middle childhood education, adolescence education, or all grade levels; or a
valid provisional, permanent, initial, or professional certificate in the title
school counselor.
(ii) The
candidate shall complete a program registered pursuant to section
52.21(b)(4)(vi) of
this Title, or its equivalent consisting of a total of six semester hours of
coursework that includes study in developing, implementing, coordinating, and
evaluating work-based learning experiences and programs.
(iii) The candidate shall have completed 300
clock hours of work experience outside of classroom
teaching.
(f)
Requirements for the extension in a world language other than English -
early childhood education (birth-grade 2) and childhood education (grades
1-6).
The candidate shall meet the requirements in each of the
following paragraphs:
(1) The candidate
shall hold a valid provisional or permanent certificate in a world language
other than English (grades 7- 12) or a valid initial, emergency COVID-19, or
professional certificate in a world language other than English (grades 5-9) or
a world language other than English (grades 7-12).
(2) The candidate shall complete a total of
three semester hours of study or its equivalent in the teaching of a world
language other than English in early childhood and childhood
education.
(g)
Requirements for the extension in American sign language.
(1) The candidate shall meet the requirements
in each of the following subparagraphs:
(i)
The candidate shall hold a valid provisional, permanent, initial or
professional certificate in the classroom teaching service.
(ii) The candidate shall submit evidence of
having achieved a satisfactory level of performance on the New York State
Teacher Certification Examination content specialty test in American sign
language.
(2) Statement
of continued eligibility.
(i) A person
employed in a position in New York State as a teacher in a position which
requires the use of American sign language, for three of the five years
immediately preceding February 2, 2004, may be issued a statement of continued
eligibility pursuant to which such person may continue to use American sign
language in the classroom teaching service without the extension prescribed in
this subdivision, provided such person holds a permanent or professional
certificate in the classroom teaching service.
(ii) A statement of continued eligibility
shall be limited to the specific permanent or professional certificate held
authorizing classroom teaching service, as prescribed in subparagraph (i) of
this paragraph, but shall be valid for service in any school
district.
(iii) Applications for
the statement of continued eligibility must be filed with the department on or
before September 1, 2008.
(h)
Requirements for the extension to
teach general science (grades 5-9).
The candidate shall meet the requirements in each of the
following paragraphs:
(1) The
candidate shall hold an initial or professional certificate in a science
(grades 5-9).
(2) The candidate
shall satisfactorily complete 18 semester hours of study in two additional
sciences.
(i)
Requirements for the extension to teach general science (grades
7-12).
The candidate shall meet the requirements in each of the
following paragraphs:
(1) The
candidate shall hold a provisional, permanent, initial or professional
certificate in a science (grades 7-12).
(2) The candidate shall satisfactorily
complete 18 semester hours in at least two additional
sciences.
(j)
Requirements for the issuance of a limited extension to teach a subject
in grades 7-8 to provide an employing entity with flexibility in the assignment
of teachers which will result in a more efficient operation of the employing
entity and a 7-8 grade level extension.
(1) Purpose. The purpose of extensions issued
under this subdivision is to authorize a teacher who is currently employed and
certified in the classroom teaching service in childhood education (grades 1-6)
or students with disabilities (grades 1-6) or an equivalent certificate title
authorizing the teaching of all common branch subjects in childhood education
(grades 1-6) to be reassigned by the employing entity to teach that subject in
grades 7-8 in order to provide an employing entity with sufficient flexibility
in the assignment of teachers which will result in a more efficient operation
of the employing entity.
(2)
Limitations. A limited extension issued under this subdivision shall be valid
for two years from its effective date and shall not be renewable. A limited
extension may be issued to a teacher currently employed by an employing entity
that meets the requirements in paragraph (3) of this section. A limited
extension shall authorize a candidate to teach a subject in grades 7-8 with
that employing entity only. Thereafter, a 7-8 grade level extension may be
issued to such teacher upon completion of the requirements in paragraph (4) of
this subdivision and shall authorize the teacher to teach a subject in grades 7
and 8 in any employing entity.
(3)
Requirements for limited extension. Notwithstanding the provisions of this
section, a limited extension may be issued to a candidate in a specific subject
area for grades 7 and 8 provided that the candidate meets the requirements in
each of the following subparagraphs:
(i) the
candidate shall hold a valid provisional, permanent, initial or professional
certificate in the classroom teaching service in childhood education (grades
1-6) or students with disabilities (grades 1-6) or an equivalent certificate
title authorizing the teaching of all common branch subjects in grades 1
through 6; and
(ii) the candidate
shall submit a statement by the chancellor, in the case of employment with the
City School District of the City of New York; or by the superintendent, in the
case of other employing boards; or by the chief school officer, in the case of
employment with another entity required by law to employ certified teachers
certifying that:
(a) the employing entity
seeks to reassign a currently employed teacher to a new teaching position in
grades 7-8 in a subject area in the classroom teaching service;
(b) the candidate meets the qualification
requirements of section
120.6 of this Title, relating to
the No Child Left Behind Act of 2001;
(c) the issuance of an extension in grades
7-8 to such candidate will result in a more efficient operation of the
employing entity;
(d) the employing
entity will provide appropriate support to the currently employed teacher
undertaking a new teaching assignment under a limited extension to ensure the
maintenance of quality instruction for students;
(e) the employing entity will require, as a
condition of employment under the extension, the candidate's enrollment in
study at an institution of higher education to complete the requirements in
paragraph (4) of this subdivision; and
(f) the employing entity will not assign the
employed teacher to teach courses for high school
credit.
(4)
Requirements for 7-8 grade level extension in a subject. Notwithstanding the
provisions of this section, an extension to teach a subject in grades 7-8 shall
be issued to a candidate in a specific subject area for grades 7 and 8 provided
that the candidate successfully completes the New York State Teacher
Certification Examination content specialty test in the subject for which a
certificate extension is being sought and six semester hours of coursework in
middle childhood education.
(k)
Requirements for a limited
extension to teach kindergarten during a period of immediate fiscal crisis and
a kindergarten extension.
(1) Purpose.
The purpose of extensions issued in this subdivision, subject to their period
of applicability as set forth in paragraph (2) of this subdivision, is to
authorize a teacher who is currently employed and certified in the classroom
teaching service in childhood education (grades 1-6) or students with
disabilities (grades 1-6) or an equivalent certificate title authorizing the
teaching of all common branch subjects in childhood education (grades 1-6) to
be reassigned by the employing entity to teach kindergarten during a
demonstrated immediate fiscal crisis to avoid or mitigate a reduction in force
consistent with the requirements of law.
(2) Applicability. The provisions of this
subdivision shall apply commencing April 27, 2010 and end on June 30,
2013.
(3) Limitations. A limited
extension issued under this subdivision shall be valid for two years from its
effective date and shall not be renewable. A limited extension may be issued to
a teacher currently employed by an employing entity, provided that the
requirements in paragraph (4) of this subdivision are met. A limited extension
shall authorize a candidate to teach kindergarten with that employing entity
only. Thereafter, a kindergarten extension may be issued to such teacher upon
completion of the requirements in paragraph (5) of this subdivision and shall
authorize the teacher to teach kindergarten in any employing entity.
(4) Requirements for a limited extension.
Notwithstanding the provisions of this section, a limited extension may be
issued to a candidate to teach kindergarten provided that the candidate meets
the requirements in each of the following subparagraphs:
(i) the candidate shall hold a valid
provisional, permanent, initial or professional certificate in the classroom
teaching service in childhood education (grades 1-6) or students with
disabilities (grades 1-6) or an equivalent certificate title authorizing the
teaching of all common branch subjects in grades 1 through 6; and
(ii) the candidate shall submit a statement
by the chancellor, in the case of employment with the City School District of
the City of New York; or by the superintendent, in the case of other employing
boards; or by the chief school officer, in the case of employment with another
entity required by law to employ certified teachers certifying:
(a) the employing entity seeks to reassign a
currently employed teacher to a new teaching position in
kindergarten;
(b) the candidate
meets the qualification requirements of section
120.6 of this Title, relating to
the No Child Left Behind Act of 2001;
(c) the employing entity is in an immediate
fiscal crisis and the issuance of a limited extension in kindergarten to such
candidate will avoid or mitigate a reduction in force;
(d) the employing entity will provide
appropriate support to the currently employed teacher undertaking a new
teaching assignment under an extension to ensure the maintenance of quality
instruction for students; and
(e)
the employing entity will require, as a condition of employment under the
extension, the candidate's enrollment in study at an institution of higher
education to complete the requirements in paragraph (5) of this
subdivision.
(5) Requirements for kindergarten extension.
Notwithstanding the provisions of this section, a kindergarten extension may be
issued to a candidate provided that the candidate satisfactorily completes six
semester hours of pedagogical coursework in early childhood
development.
(l)
Requirements for the issuance of a limited extension to teach a subject
in grades 5-6 to provide an employing entity with flexibility in the assignment
of teachers which will result in a more efficient operation of the employing
entity and a 5-6 grade level extension in a subject.
(1) Purpose. The purpose of extensions issued
under this subdivision is to authorize a teacher who is currently employed and
certified in the classroom teaching service in a certain subject in grades 7-12
and who has demonstrated an appropriate academic background to teach in the
subject area of his/her grade 7-12 certificate, to be reassigned by the
employing entity to teach that subject in grades 5-6 in order to provide an
employing entity with flexibility in the assignment of teachers which will
result in a more efficient operation of the employing entity.
(2) Limitations. A limited extension issued
under this subdivision shall be valid for two years from its effective date and
shall not be renewable. A limited extension may be issued to a teacher
currently employed by an employing entity that meets the requirements in
paragraph (3) of this subdivision. A limited extension shall authorize a
candidate to teach a subject in grades 5-6 with that employing entity only.
Thereafter, a 5-6 grade level extension may be issued to such teacher upon
completion of the requirements in paragraph (4) of this subdivision and shall
authorize the teacher to teach a subject in grades 5-6 in any employing
entity.
(3) Requirements for a
limited extension to teach a subject in grades 5-6. Notwithstanding the
provisions of this section, a limited extension may be issued to a candidate in
a subject for grades 5-6 provided that the candidate meets the requirements in
each of the following subparagraphs:
(i) the
candidate shall hold a valid provisional, initial, permanent, or professional
certificate in English language arts (7-12), world language other than English
(7-12), mathematics (7-12), biology (7-12), chemistry (7-12), earth science
(7-12), physics (712), or social studies (7-12); and
(ii) the candidate shall submit a statement
by the chancellor, in the case of employment with the City School District of
the City of New York; or by the superintendent, in the case of other employing
boards; or by the chief school officer, in the case of employment with another
entity required by law to employ certified teachers certifying:
(a) the employing entity seeks to reassign a
currently employed teacher to a new teaching position in grades 5-6 in a
subject area in the classroom teaching service;
(b) the candidate meets the qualification
requirements of section
120.6 of this Title, relating to
the No Child Left Behind Act of 2001;
(c) the issuance of an extension in grades
7-8 to such candidate will result in a more efficient operation of the
employing entity;
(d) the employing
entity will provide appropriate support to the currently employed teacher
undertaking a new teaching assignment under a limited extension to ensure the
maintenance of quality instruction for students; and
(e) the employing entity will require, as a
condition of employment under the extension, the candidate's enrollment in
study at an institution of higher education to complete the requirements in
paragraph (4) of this subdivision.
(4) Requirements for a 5-6 grade level
extension in a subject area. A 5-6 grade level extension may be issued to a
candidate in a specific subject area provided that the candidate meets the
requirements of subdivision (b) of this section.
(m) Requirements for the extension to teach
certain subjects in grades 7-12.
(1) Purpose.
The purpose of an extension issued under this section is to authorize a teacher
who holds a valid initial, emergency COVID-19, or professional certificate in
the classroom teaching service in students with disabilities (grades 5-9)
generalist, students with disabilities (grades 5-9) content specialist,
students with disabilities (grades 7-12) generalist, students with disabilities
(grades 7-12) content specialist, students with disabilities (all grades), or
the special education generalist permanent certificate to authorize the teacher
to be employed as the teacher of record for students with disabilities in
certain subjects.
(2) Subjects for
which extension may be obtained. A teacher who holds a valid initial, emergency
COVID-19, or professional certificate in the classroom teaching service in
students with disabilities (grades 5-9) generalist, students with disabilities
(grades 5-9) content specialist, students with disabilities (grades 7-12)
generalist, students with disabilities (grades 7-12) content specialist,
students with disabilities (all grades), or the special education generalist
permanent certificate may seek an extension under this subdivision in one of
the following subjects: mathematics; English language arts; biology; chemistry;
earth science; physics; social studies; language other than English (specified)
in either (grades 5-9) or (grades 7 through 12).
(3) Requirements for the extension. The
candidate shall meet the requirements in each of the following paragraphs:
(i) the candidate shall hold a valid initial,
emergency COVID-19, or professional certificate in students with disabilities
(grades 5-9) generalist, students with disabilities (grades 5-9) content
specialist, students with disabilities (grades 7-12) generalist, students with
disabilities (grades 7-12) content specialist, students with disabilities (all
grades), or the special education generalist permanent certificate;
and
(ii) the candidate shall
complete the New York State teacher certification examination content specialty
test in the subject for which a certificate extension is being sought or the
candidate shall satisfactorily complete at least 12 semester hours of study or
its equivalent in the subject area of the certificate sought. For social
studies, the candidate shall complete the 12 semester hours through a
combination of study in United States history, world history, and
geography.
(4)
Collaboration. Any district or BOCES employing a teacher that holds an
extension under this subdivision must provide weekly collaboration between a
certified general education content specialist in the subject and the teacher
who holds an extension under this subdivision, with at least one period per
month co-taught by both teachers. The length of the required weekly
collaboration and co-taught lesson shall be defined at the local level. For
teachers employed by a school enumerated in article 81, 85, 87, 88 or 89 of the
Education Law or a special act school district as defined in subdivision 8 of
section 4001 of the Education Law and such school cannot meet the requirements
of this subdivision, the school shall submit a plan acceptable to the
department with a description of the mentoring and collaboration the candidate
will receive.
(n)
Requirements for a grade-level extension to teach students with disabilities
(grades 3-4). The candidate shall meet the requirements in each of the
following paragraphs:
(1) the candidate shall
hold a valid initial or professional certificate in students with disabilities
(birth - grade 2);
(2) the
candidate shall submit satisfactory evidence of at least three school years of
teaching experience; provided that at least 75 percent of the candidate's time
is spent teaching students with disabilities in grades 1 and/or 2 in the public
schools of this State while holding a valid certificate, during each of the
three school years; and
(3) the
candidate must either:
(i) provide
satisfactory evidence of completion of at least 45 hours of acceptable
continuing teacher and leader education focused on students with disabilities
at the elementary level; or
(ii)
the candidate shall complete a minimum of three semester hours of satisfactory
pedagogical study or its equivalent, that is focused on students with
disabilities at the elementary level.
(o) Requirements for a grade-level extension
to teach students with disabilities in pre-kindergarten and kindergarten. The
candidate shall meet the requirements in each of the following paragraphs:
(1) the candidate shall hold a valid initial
or professional certificate in students with disabilities (grades
1-6);
(2) the candidate shall
submit satisfactory evidence of at least three years of teaching experience;
provided that at least 75 percent of the candidate's time is spent teaching
students with disabilities in grades 1 and/or 2 in the public schools of this
State while holding a valid certificate, during each of the three school years;
and
(3) the candidate must either:
(i) provide satisfactory evidence of
completion of at least 45 hours of acceptable continuing teacher and leader
education focused on students with disabilities at the early childhood level;
or
(ii) the candidate shall
complete a minimum of three semester hours of satisfactory pedagogical study or
its equivalent, that is focused on students with disabilities at the early
childhood level.
(p) Requirements for the extension to teach
students with disabilities (grades 7-8). The candidate shall meet the
requirements in each of the following paragraphs:
(1) the candidate shall hold a valid initial
or professional certificate in students with disabilities (grades
1-6);
(2) the candidate shall show
satisfactory evidence of a minimum of three years of teaching experience;
provided that at least 75 percent of the candidate's time is spent teaching
students with disabilities in grades 5 and/or 6 in the public schools of this
State while holding a valid certificate, during each of the three school years;
and
(3) either:
(i) provide satisfactory evidence of
completion of at least 45 hours of acceptable continuing teacher and leader
education focused on students with disabilities at the middle level;
or
(ii) the candidate shall
complete a minimum of three semester hours of satisfactory pedagogical study or
its equivalent, that is focused on students with disabilities at the middle
level.
(q)
Requirements for a grade-level extension to teach students with disabilities
(grades 5-6). The candidate shall meet the requirements in each of the
following paragraphs:
(1) the candidate shall
hold a valid initial or professional certificate in students with disabilities
(grades 7-12) generalist and students with disabilities (grades 7-12) content
specialist;
(2) the candidate shall
show satisfactory evidence of a minimum of three years of teaching experience;
provided that at least 75 percent of the candidate's time is spent teaching
students with disabilities in grades 7 and/or 8 in the public schools of this
State while holding a valid certificate, during each of the three school years;
and
(3) either:
(i) provide satisfactory evidence of
completion of at least 45 hours of acceptable continuing teacher and leader
education focused on students with disabilities at the middle level;
or
(ii) the candidate shall
complete a minimum of three semester hours of satisfactory pedagogical study or
its equivalent, as determined by the Commissioner, that is focused on students
with disabilities at the middle level.
(r) Requirements for a grade-level extension
to teach students with disabilities (grades 10-12). The candidate shall meet
the requirements in each of the following paragraphs:
(1) the candidate shall hold a valid initial
or professional certificate in students with disabilities (grades 5-9)
generalist and students with disabilities (grades 5-9) content
specialist;
(2) the candidate shall
submit satisfactory evidence of at least three school years of teaching
experience; provided that at least 75 percent of the candidate's time is spent
teaching students with disabilities in grades 8 and/or 9 in the public schools
of this State, State-supported or State-operated schools, private schools
established under chapter 853 of the Laws of 1976 or BOCES, while holding a
valid certificate, during each of the three school years; and
(3) the candidate shall:
(i) provide satisfactory evidence of
completion of at least 45 hours of acceptable continuing teacher and leader
education or a minimum of three semester hours focused on students with
disabilities at the adolescent level (grades 10-12); and
(ii) complete at least 15 hours of acceptable
continuing teacher and leader education or a minimum of three semester hours
focused on English language arts.
(s) Requirements for the issuance of a
limited extension to teach a specific subject in a special class in grades
7-12.
(1) Purpose. The purpose of limited
extensions issued under this subdivision is to authorize a teacher who holds a
valid initial, emergency COVID-19, or professional certificate in the classroom
teaching service in students with disabilities (grades 7-12) generalist,
students with disabilities (grades 7-12) content specialist, students with
disabilities (grades 5-9) generalist, students with disabilities (grades 5-9)
content specialist, students with disabilities (all grades), or the special
education generalist permanent certificate to teach one of the following
subject areas in a special class as defined in section
200.1(uu) of this
Title: biology, chemistry, earth science, English Language Arts, general
science, language other than English (specified) in either (grades 5-9) or
(grades 7-12), mathematics, physics, and social studies.
(2) Limitations. A limited extension in a
specific subject area issued under this subdivision shall be valid for five
years from its effective date and may be renewed once for an additional five
years if the candidate has completed at least three semester hours of
coursework in the subject area of the limited extension sought prior to the
expiration date of the first issuance of the limited extension. Candidates may
apply for multiple limited extension(s) in different subject area(s).
(3) Requirements for a limited extension. A
limited extension may be issued to a candidate in a specific subject area
provided that the candidate holds a valid initial, emergency COVID-19, or
professional certificate in the classroom teaching service in students with
disabilities (grades 7-12) generalist, students with disabilities (grades 712)
content specialist, students with disabilities (grades 5-9) generalist,
students with disabilities (grades 5-9) content specialist, students with
disabilities (all grades), or the special education generalist permanent
certificate and meets the requirements in one of the following subparagraphs:
(i) the candidate shall submit evidence of
having at least two years of satisfactory full-time teaching experience in a
public school, State-supported or State-operated school, or private schools
established under 853 of the Laws of 1976 prior to June 30, 2021 during which
time the candidate met the qualifications to be considered highly qualified for
a core academic subject for purposes of the No Child Left Behind Act under the
former 34 C.F.R.
200.56 through passing the high, objective,
uniform State standard of evaluation rubric (HOUSSE) to demonstrate subject
matter competency in grades 7-12 in the subject area for which the limited
extension was sought. The candidate shall submit, as part of the application,
the completed HOUSSE rubric from the district(s) for each year of experience
for each subject area that the candidate seeks a limited extension;
(ii) receive a satisfactory passing score on
an industry-accepted examination that demonstrates mastery in the subject area
for which the limited extension is sought or in a closely related area that is
approved by the department through a request for qualifications
process;
(iii) complete at least
nine semester hours of coursework in the subject area in which the limited
extension is sought; or
(iv)
provide satisfactory evidence of completion of at least 45 hours of acceptable
continuing teacher and leader education focused in the subject area in which
the limited extension is sought and provide satisfactory evidence of either
clause (
a) or (
b) of this subparagraph:
(a) at least two years of satisfactory
full-time teaching experience in grades 7-12 in the subject area in which the
limited extension is sought or in a closely related subject area acceptable to
the department; or
(b) an
employment and support commitment from a public school district or a
State-supported or State-operated school or private school established under
853 of the Laws of 1976 for the teacher to be employed in a special class as
defined in section
200.1(uu) of this
Title for the period of the limited extension that shall include a plan from
the school or school district for mentoring and appropriate instructional
support from a teacher in the school or school district who holds a
professional or permanent certificate and is certified in the subject area in
which the limited extension is sought. Mentoring shall include regular, ongoing
collaboration between the teachers and types of mentoring activities may
include, but are not limited to, modeling instruction, observing instruction,
instructional co-planning, peer coaching, and team
coaching.
