Section 56.4 - Transmittal of information to test subjects

(a) Each request by a test subject, pursuant to section 342(2) of the Education Law, shall be in writing and signed by the test subject. Such material shall be transmitted to the test subject within 30 days after receipt of each such request by the test sponsor or the sponsor's designated agent, or within 15 days after such sponsor or such agent has filed with the commissioner the test data in accordance with section 342(1) of the Education Law, whichever shall occur later.

(b) Each test subject's answer sheet shall be considered to include any documents or materials which are prepared or produced by the test subject during the test administration and which are evaluated by the test sponsor or the sponsor's designated agent for purposes of determining the subject's score or performance on the test.

(c) The test sponsor or the sponsor's designated agent may provide the test subject with a photocopy of the test subject's answer sheet.
