Section 3.38 - Tuition of nonresident pupils

No school shall be entitled to compensation from public moneys for the tuition of nonresident academic pupils unless such pupils, while under instruction:

(a) resided in a district of this State which did not then maintain an approved academic department of a grade which the pupil was qualified to enter;

(b) were duly qualified for admission as prescribed by the commissioner.
