Section 142.10 - Contractor compliance reporting

(a) State agencies are responsible for determining compliance by contractors with goals established in State contracts.
(b) A State agency may determine that a contractor is complying with contract goals set forth in the utilization plan if:
(1) the contractor is a
certified minority or women-owned business enterprise and is responsible for
one hundred percent of the contract performance;
(2) the State agency has verified that the
contract goals are being achieved with certified, value added enterprises;
or
(3) a review of contractor
compliance reports and the determination of compliance is consistent with
procedures or actions described in the State agency's master goal
plan.
