The judge of each court having countywide jurisdiction in a county which has not placed in operation a plan conforming to that described in subdivision 3 of section 722 of the County Law, shall submit to the Appellate Division on or before the first day of June each year, a list of attorneys residing within such county for approval by the Appellate Division for the purpose of assignment as counsel pursuant to section 35 of the Judiciary Law. As far as practicable, a judge or justice shall assign attorneys from the approved list in rotation.
