Upon application of a defendant, pursuant to C PL 460.50, for an order staying or suspending the execution of the judgment pending the determination of an appeal taken to the Appellate Term, such order may be issued by a justice of the Appellate Term for the Ninth and Tenth Judicial Districts or a justice of the Supreme Court of the judicial district embracing the county in which the judgment was entered.
