Section 2002.4 - State budget director determination

Upon the written request of a municipality as set forth in subdivision (c) of section 2002.3 of this Part, the corporation shall:

(a) Certify to the State Director of the Budget that the estimated charge to be collected by the corporation from the municipality is fair and reasonable in relation to the estimated project cost, and that sufficient provisions exist in the agreement to insure that the municipality shall at all times have sufficient moneys on deposit with the corporation in advance of such charges pursuant to section 2002.5 of this Part.

(b) Submit the estimated project budget, including fair and reasonable charges for the corporation's services, and the proposed agreement to the State Director of the Budget for his determination that the total estimated charge to be collected by the corporation from the municipality is fair and reasonable in relation to the estimated total project cost, and that sufficient provisions exist to ensure the collection of such charge by the corporation from the municipality.

(c) Any amendment to the agreement or any other action which would affect any prior determination made by the State Director of the Budget pursuant to subdivision (b) of this section shall be resubmitted to the State Director of the Budget for his redetermination before becoming effective.
