Section 1263.39 - Free use of air terminal

Notwithstanding the provisions of any schedule of charges heretofore adopted for the use of the public areas at Newark Airport, no charge shall be made for the use of such areas at such air terminal by the following aircraft:

(a) Aircraft owned by the Federal government and operated by Army, Navy, Marine Corps, Coast Guard or Air Force personnel provided, however,

(1) that the total movements of all such aircraft do not exceed 25 landings per day or 300 landings per month and

(2) that no such aircraft is parked or stored in the public areas at the airport more than 24 consecutive hours after a landing.

(b) Aircraft owned by the Federal government and carrying as a passenger or landing to embark as a passenger the President of the United States, the Vice President of the United States, a member of the Congress of the United States or any civilian officer of an executive department of the United States with the rank of or equivalent to secretary, under secretary or assistant secretary of such executive department, provided, however, that movements of such aircraft shall constitute movements under subdivision (a) above.

(c) Aircraft owned by the Federal government carrying as a passenger or landing to embark as a passenger an officer of flag rank of the United States Navy or Coast Guard or an officer of general rank of the United States Army, Air Force or Marine Corps, provided, however, that movements of such aircraft shall constitute movements under subdivision (a) above. (This means that all aircraft movements, including those carrying officials and officers as stipulated above, are counted toward the 25-300 limit but charges are levied above 25-300 limit only on aircraft not carrying officials and officers as stipulated herein: flag rank--commodore, rear admiral, vice-admiral and admiral; general rank-- brigadier general, major general, lieutenant general and general.)

(d) Aircraft operated by the Federal Aviation Administration or the Civil Aeronautics Board.

(e) Aircraft owned by the Federal government when required to make landings in emergency circumstances because of inability to continue in flight safely.

(f) Aircraft owned by the State of New York or the State of New Jersey or the City of New York, or the City of Newark.

(g) Aircraft operated by the United States Coast Guard when engaged in the execution of search and rescue and law enforcement duties.

(h) Aircraft owned or chartered by The Port Authority of New York and New Jersey.
