Section 1262.39 - Use of fuel and lubricant facilities restricted

(a) Unless otherwise provided in a lease or other agreement, all operators of aircraft using Kennedy International Airport who receive, and all persons who supply, aviation fuel and lubricating oil at said air terminal, shall use the aviation fuel storage and delivery facilities, constructed by the Port Authority on the south side of Bergen Basin, or such other facilities as may be designated by the Port Authority for such use.
(b) If and for any period during which said facilities are not available, said operators may make other arrangements with their suppliers of aviation fuel for deliveries thereof to their aircraft, provided that such other arrangement shall be subject to the approval of the Port Authority from the standpoint of safety, traffic control and similar matters.
