Part 1153 - Dangerous Articles
Section 1153.5 - Radioactive materials

(a) No person shall, without prior permission, store, keep, handle, use or transport at, in or upon a terminal the following radioactive materials:

(1) Source material as defined in standards for protection against radiation promulgated by the Atomic Energy Commission (10 CFR Part 20) including, but not limited to, uranium, thorium, or any combination thereof (but not including the "unimportant quantities of source material" set forth in 10 CFR 40.13).

(2) Special nuclear material as defined in standards for protection against radiation promulgated by the Atomic Energy Commission ( 10 CFR Part 20) including, but not limited to, plutonium, uranium 233, uranium enriched in the isotope 233 or in the isotope 235, or any material artificially enriched by any of the foregoing.

(3) Nuclear reactor fuel elements that are partially expended or irradiated.

(4) New nuclear reactor fuel elements.

(5) Radioactive waste material.

(6) Any radioactive material moving under a Department of Transportation special permit or Atomic Energy Commission permit and escort.

(b) Advance notice of at least 24 hours shall be given to the manager to permit full investigation and clearance for any operation requiring a waiver of this section. Permission may be given to movements of radioactive materials only when such materials are packaged, marked, labeled and limited as required by the Department of Transportation, the United States Coast Guard regulations and Federal Aviation Administration regulations applying to transportation of explosives and other dangerous articles and do not create an undue hazard to life or property at the terminal.
