New York Codes, Rules and Regulations
Title 21 - Miscellaneous
Chapter XV - New York State Commission Of Investigation
Part 701 - Access To Personal Information Held By The Commission Of Investigation
Section 701.9 - Fees

Current through Register Vol. 46, No. 12, March 20, 2024

(a) Unless otherwise allowed by statute, no fee will be charged for:

(1) inspecting records;

(2) searching for records; or

(3) any certification pursuant to this Part.

(b) Unless otherwise allowed by statute, copies of records shall be provided:

(1) at a minimum rate of 25 cents per photocopy up to 8 1/2 x 14 inches; or

(2) upon payment of the actual cost of reproduction, if the record or personal information cannot readily be photocopied on machinery owned or leased by the commission or if outside contractors are required to copy the record involved.

(c) The commission, at its discretion, may, in instances it deems appropriate, waive any fee or provide records at lower fees. The data subject will be notified if such a waiver or reduction in fees has been granted. However, when records are provided for less than the fee allowed by law, a waiver or reduction shall be deemed to have been granted. A waiver or reduction granted to any data subject or in response to any particular request shall not require the commission to grant any further waiver or reduction in fees with respect to any other data subject or request.
