Part 4050 - Implementation Of State Environmental Quality Review Act
Section 4050.1 - Purpose and authority

(a) The purpose of this Part is to establish such additional procedures as are necessary for the implementation of the State Environmental Quality Review Act, article 8 of the Environmental Conservation Law (hereinafter referred to as the "act") by the Genesee County Industrial Development Agency (hereinafter referred to as the "issuer"). Procedures applicable to actions of the issuer are also contained in the act and in 6 NYCRR Part 617.

(b) It is the purpose of the issuer to promote, develop, encourage and assist in the acquiring, constructing, reconstructing, improving, maintaining, equipping and furnishing of industrial, manufacturing, warehousing, commercial, research and winter recreation facilities including industrial pollution control facilities and thereby advance the job opportunities, health, general prosperity and economic welfare of the people of the State of New York and to improve their recreation opportunities, prosperity and standard of living. In meeting these objectives, the issuer seeks to strike a suitable balance among competing social, economic and environmental factors. It is the intention of this Part that social, economic and environmental factors be incorporated in the decision-making processes of the issuer. It is not the intention of this Part that environmental factors by the sole consideration in the issuer's decision-making.

(c) The authority for the issuance of this Part is contained in section 8- 0113(3) of the act and in 6 NYCRR 617.10.
