Section 4000.1 - Functions of the board

(a) Although the primary function of the State Mediation Board is to take all steps which will effectively and expeditiously carry out the policy of the New York State Legislature and maintain industrial peace through mediation as set forth in article 21 of the State Labor Law, the board has an additional function--that of arbitration.

(b) The services of the board will be provided to resolve disputes between an employer and a labor organization in the following situations:

(1) Where there is a collective bargaining agreement containing an arbitration clause and the State Mediation Board is named as the arbitration agency, or

(2) The parties by an agreement in writing submit a dispute or grievance to the board for arbitration.

(c) The maintenance of industrial peace is the watchword of the State Mediation Board, and it strives to accomplish this end through the resolution of disputes through mediation and arbitration at the voluntary request of the parties to the dispute.
