Section 10085.15 - Penalties and damages

(a) Any person found to be violating any provision of this regulation shall be served by the commissioner with written notice stating the nature of the violation and providing a reasonable time for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations.

(b) Violation of these regulations shall subject the offending party to a civil penalty in an action brought by the water board, not exceeding $100 for each day the violation continues. The Water Board Act has conferred jurisdiction upon the city court in Buffalo, New York to hear and determine, subject to the provisions of the Civil Practice Law and Rules, any violation of such rules and regulations.

(c) Any person violating any of the provisions of this Part shall become liable to the water board for any real costs, expense, loss, or damage incurred by the water board by reason of such violation. The expense, loss or damage shall be taken to be to the extent determined by the commissioner.
