Section 9001.7 - Statement of disagreement by data subject

(a) If a request is denied in whole or in part, upon appeal, the person designated to determine appeals shall inform the data subject of the right to:

(1) file with the authority a statement setting forth the reasons for disagreement with the determination; and

(2) request that such a statement be provided to any person or governmental unit to which the record has been or is disclosed pursuant to Public Officers Law, section 96(1)(d), (i) or (l).

(b) Upon receipt of a statement of disagreement by a data subject, the authority shall clearly note portions under dispute, attach a copy as part of the record, and advise governmental agencies of reasons for denial.
