Section 9001.6 - Appeal

(a) Any person denied access to a record or denied a request to amend or correct a record of personal information will be informed of the right to appeal within 30 days of such denial, to the President of Battery Park City Authority, pursuant to section 9000.3(a) of this Title (freedom of information regulations) and will be informed of the right to seek judicial review of appeal determination pursuant to article 78 of the Civil Practice Law and Rules. Failure to respond to appeal within 10 business days of receipt of appeal may be construed as a denial.

(b) Personal information corrected or amended, on appeal, will be provided to any person or governmental unit to which the record or personal information has been or is disclosed pursuant to Public Officers Law, section 96(1)(d), (i) or (l).

(c) All appeals, determinations and reasons therefor shall be immediately forwarded to the Committee on Open Government.
