Appendix 23-A

Exempt Acts include:

1. Any act, decision, or commitment required to be made within a specific time limit set by law, rule, regulation or set by other legally imposed requirement where such time limit renders impact statement analysis impossible.

2. Actions necessitated by emergencies including, but not limited to:

a.) Clean-up of flood and storm damage.

b.) Emergency local assistance.

c.) Accident clean-up.

3. Approval and execution of grants or contracts for the rehabilitation, maintenance or repair of existing transportation facilities or structures not involving an expansion of the facility or structure.

4. Approval and execution of grants or contracts for the purchase of equipment which will be used to rehabilitate, maintain or repair existing transportation facilities or structures.

5. All ministerial acts including, but not limited to those listed in Appendix B of this Part.
