Section 8200-2.2 - Failure to file

(a) Whenever it shall appear that a railroad owner has failed to file a report or reports in a prescribed format as determined by ORPTS as of the date required by this Subpart, an adjudicatory proceeding concerning the alleged failure will be held in the manner provided in Part 8187 of this Title.

(b) If it is determined, pursuant to such adjudicatory proceeding, that the railroad owner has failed to file a report or reports in the time and manner provided in this Subpart, the following penalties will be imposed upon the railroad owner:

(1) a penalty of $100 for each failure; and

(2) an additional fine of $50 per day for each day the failure continues, beginning with the day on which the failure first occurred.
