Part 679 - Specifications For Local Social Services Commissioner And Deputy Social Services Commissioner
Section 679.7 - Appointment of qualified persons

No person shall be appointed or serve as a local social services commissioner or deputy commissioner who does not meet the minimum qualifications required for the position by the regulations of the department, except

(a) for the person who qualifies for commissioner pursuant to section 26 of chapter 1071 of the Laws of 1965 by reason of having served in the position on December 31, 1965 and

(b) for the person nominated to serve as acting commissioner pursuant to section 65 of the Social Services Law which authorizes the appointment of any employee of a social services district as acting commissioner for a period not exceeding one year, in the absence of qualified candidates and subject to the approval of the State Commissioner of Social Services.
