Section 638.2 - Conditions for reimbursement for energy assistance

(a) Energy assistance costs required to be allocated or distributed to other programs by regulations or direction of the department shall be claimed as so required. Such costs shall be allocated or distributed in accordance with the requirements set forth in Part 602 of this Title.
(b) Emergency energy or interim energy assistance costs that cannot be claimed as energy assistance reimbursable pursuant to this Part shall be claimed in accordance with department regulations or directives pertaining to emergency assistance.
(c) Costs relating to energy assistance that cannot be claimed pursuant to this Part must be claimed in accordance with other department regulations or directives for the program or activity for which such costs may be claimed and must be claimed in accordance with the requirements set forth in department regulations pertaining to the allocation of expenditures for public assistance and care.
(d) No portion of any claim for reimbursement for energy assistance may be supported solely with State funds without Federal participation if reimbursement may be claimed from a program for which Federal participation is available.
(e) Any claims for reimbursement from any portion of an activity or program for which there is Federal participation which were not fully reimbursed as claimed and which were properly made at the time they were originally claimed may be reclaimed as expenses for which Federal participation is available if such claims were appropriate when originally submitted. This subdivision shall apply only when the revised claim is timely and not in excess of any ceiling or limitation for Federal participation and an adjustment to reduce the original claim is simultaneously submitted to the department.
(f) Claims for reimbursement for energy assistance provided to eligible individuals shall not be submitted if such claims seek reimbursement rates or amounts which are greater than otherwise permitted by the department.
(g) Except as otherwise specifically authorized by Federal or State law or regulations or as specifically directed by the department, claims for reimbursement for energy assistance provided to eligible individuals shall be submitted in the manner required by such law, regulations or directive.
(h) Any adjustment of claims for reimbursement, including adjustments to claims as a result of recoveries or collections, shall be made in accordance with procedures, instructions or directions of the department.
