Section 633.3 - Reapportionment of Title XX funds

(a) After the end of each Federal fiscal year, the amount of Title XX funds expended by each district shall be calculated by the department.

(b) Any unused Title XX funds will be reallocated proportionally among the local districts whose claims have exceeded their Title XX ceilings.

(c) The amounts to be reallocated pursuant to subdivision (b) of this section must be determined by the following process:

(1) The total of the unexpended Title XX funds will be determined on the basis of claims, adjustments and disallowances processed for a Federal fiscal year that were received no later than six months following the close of such Federal fiscal year.

(2) The department will determine the amount of the unexpended Title XX funds for those districts which had not exceeded their Title XX ceiling and establish the total statewide unexpended Title XX funds.

(3) The department will determine the amount of overexpended Title XX funds for those districts which had exceeded their Title XX ceiling and establish the amount of the total statewide overexpended Title XX funds.

(4) The department will establish the reallocation percentage by dividing the total unexpended Title XX funds by the total overexpended Title XX funds.

(5) The department will establish the reapportionment amount due those districts which have exceeded their Title XX ceiling by multiplying the reallocation percentage by the amount each district exceeded its Title XX ceiling.

(d) The amount of Title XX funds to be reallocated pursuant to subdivision (c) of this section will be the final allocation of Title XX funds made to a local social services district. No further reallocation of Title XX funds will be made to the local districts for a particular Federal fiscal year.

(e) On the basis of the final apportionment of Title XX funds to be made available to social services districts, payments will be processed by the department which will be reflected on the districts' settlement notices.
