Section 628.2 - Conditions for reimbursement for foster care

(a) No portion of any claim for reimbursement may be supported solely with State funds if reimbursement may be claimed from a program for which there is Federal participation.
(b) Any claims for reimbursement from a program or activity for which there is Federal participation which were not fully reimbursed as claimed and which were properly made at the time they were originally submitted to the department may be claimed as child care services for which Federal financial participation may be claimed as foster care and adoption assistance pursuant to title IV-E of the Social Security Act or aid to families with dependent children (AFDC) or other expenditures for which such participation is available if they could have been so claimed when originally submitted, provided that the revised claim is timely and that an adjustment made to reduce the original claim is simultaneously submitted to the department.
(c) Any claims for reimbursement made from a program or activity for which there is Federal participation which were not reimbursed and which were properly made at the time they were submitted to the department may be claimed as if Federal participation was not available if the claims were appropriate at the time they were originally submitted, provided that the revised claim is timely and that an adjustment is simultaneously submitted to the department to reduce the original claim.
(d) Claims for reimbursement for child care services expenditures shall not be submitted if such claims seek reimbursement at rates or amounts that are greater than otherwise permitted by the department in accordance with section 398-a or 432 of the Social Services Law or by provisions of any other law or regulation.
(e) Any claims for reimbursement for child care services expenditures which are subsequently determined by the department to be reimbursable from another program for which Federal participation is available and for which a higher proportion of Federal participation could be received shall be reduced in an amount equivalent to the amount determined by the department to be due as a result of the availability of additional Federal participation.
(f) Any adjustments to claims for reimbursement, including adjustments to claims as a result of recoveries or collections, shall be made in accordance with procedures, instructions or directions of the department.
