Section 519.12 - Withdrawal or abandonment of a request for hearing

(a) A request for a hearing is abandoned if the hearing has not been rescheduled and the appellant does not appear at the hearing on the scheduled date.

(b) A hearing request may be withdrawn only under the following circumstances:

(1) the department receives a written statement from the appellant stating that the request is withdrawn; or

(2) the appellant makes a statement on the record at the hearing withdrawing the request.
