Section 491.11 - Facility charges

(a) To the extent that a resident of a shelter for adults, small-capacity shelter or shelter for adult families has income, unless otherwise provided by law the resident must pay for the actual costs of their care, pursuant to the budgeting requirements set forth in Part 352 of this Title. For recipients of Safety Net Assistance, Veteran Assistance, or Emergency Assistance for Adults, SSI or additional State payments, public assistance budgeting rules set forth in Part 352 of this Title must be used in determining the amount of available income to be applied toward the costs of care.

(b) Any amounts which are not permitted to be counted as income under the assistance program applicable to the resident shall not be counted as income for purposes of this section.
