Part 489 - Adult Care Facilities Standards for Family-type Homes
Section 489.5 - Inspection and enforcement

(a) Inspection.

(1) Responsibility for the inspection and supervision of family-type homes has been delegated by the commissioner to the commissioners of local social services districts in which the family-type home for adults is located.

(2) Unless otherwise specified, the definitions and procedures set forth in sections 486.1 and 486.2 of this Title must apply. A complete unannounced inspection of each certified family-type home must be conducted at least annually. Additional inspections must be conducted by the social services district when necessary to ensure the health, safety and well-being of the residents.

(3) The local department shall notify the appropriate regional office of the department of any uncertified homes which reasonably appear to be family-type homes for adults and shall, upon the request of the department, inspect any such homes.

(b) Enforcement.

At the request of the department, the local district shall participate in hearings or other enforcement related activities.
