Section 449.2 - Conditions for application and approval of a supervised setting program

(a) An authorized agency may not operate a supervised setting program until it receives the written approval of OCFS.
(b) An authorized agency desiring to operate a supervised setting program must apply to OCFS for authorization to operate such a program in a manner as required by OCFS. Such application must include:
(c) A review to determine the applicant's compliance with OCFS requirements will be conducted by OCFS after the receipt of the application and all required supporting documentation.
(d) A notice of approval or denial of the application will be issued by OCFS after the completion of the review.
(e) Supervised settings are subject to the inspection, supervision and enforcement powers of OCFS, as set forth in Article 7 of the Social Services Law.
