Section 426.8 - Assignment of support rights

(a) Approved applications for foster care maintenance payments which are reimbursable pursuant to title IV-E of the Social Security Act constitute an assignment to the State and the social services district concerned, of any rights to support from any other person as such applicant may have in his or her own behalf. Such approved applications must be referred to the child support enforcement unit of the social services district for appropriate action in accordance with the requirements of Part 422 of this Title.

(b) Any income or resources collected as child support for a child or children of a minor parent in foster care or in an adoptive placement for whom the costs of care are provided through the title IV-E foster care maintenance payments or adoption assistance payments of the minor parent must be disregarded. Such child support does not constitute an assignment to the State or the social services district.
