Part 399 - Food Stamp Fraud And Food Stamp Intentional Program Violations-disqualification
Section 399.10 - Limitations

(a) Administrative food stamp fraud hearings will be scheduled by the department based upon a determination by the department of sufficiency as set out in section 399.6(c) of this Part.

(b) Administrative disqualification hearings will be scheduled by the department based upon a determination by the department provided that not more than six years has elapsed between the month an overissuance occurred and the date which the local social services district discovered the overissuance and upon a determination of sufficiency as set out in section 399.7(d) of this Part.

(c) The department will not schedule either administrative food stamp fraud hearings or administrative disqualification hearings where the total amount of the overissuance is less than $35.
