Section 973.6 - Exercise of preferential right or release

Upon receipt of notification that the Department of Transportation and/or other State or local governmental agency or transportation authority intends to exercise the preferential right of acquisition, the railroad company may, by certified letter addressed to the Director, Real Estate Division, New York State Department of Transportation, Building 5, State Campus, Albany, New York 12232, with copy to the authorized agency or transportation authority, if any, demand that the preferential right of acquisition be properly exercised within 120 days, or released through the New York State Department of Transportation.
