Section 919.5 - Notification of intent to close an existing private rail crossing impacting public access to lands open to the public for recreational use

(a) The commissioner shall solicit public comment on any proposed alteration or closure of an existing private rail crossing which would impact public access to lands open to the public for recreational use. The commissioner shall ensure that any such comments received are considered by the department in any decision to alter or close such a private rail crossing.

(b) The commissioner shall not close any private rail crossing that provides direct access to public State recreational lands unless the department, in consultation with the State agency with jurisdiction over such lands, finds that there is a reasonable alternative route that maintains such public access to and the public recreational value of such lands
