Section 504.3 - Appeals

In the event of an adverse ruling by the presiding officer during the pendency of a proceeding, the aggrieved party may appeal within 10 days to the commissioner. Such an appeal must be in writing and may be served upon the department electronically with copies served on all parties of record and their representatives. During the pendency of th e appeal the presiding officer's rulings will be in full force and effect. On appeal, the commissioner may affirm, reverse or modify a ruling of the pre siding officer. The commissioner may affirm a ruling by a presiding officer by refusing to reverse or modify that ruling within 30 days after t he appeal is filed.
