Section 162.1 - General

Subdivision 9 of section 10 of the Highway Law gives the power and duty of the Commissioner of Transportation to prescribe rules and regulations not inconsistent with law, fixing the duties of county and town superintendents in respect to all highways and bridges and determining the method of the construction, improvement or maintenance of such highways and bridges. Such subdivision also requires that such rules and regulations shall, before taking effect, be printed and transmitted to the highway officers affected thereby. It is the intent of this Part to provide a procedure whereby county and town superintendents may perform their duties in certain instances with the assistance of the Department of Transportation.
