Section 30.8 - Monthly report

(a) Every licensee shall submit a monthly report to the commissioner, which shall be made on forms provided by the commissioner and shall contain the following information:

(1) the total number of barrels of petroleum transferred to the licensee's major facility during the previous month;

(2) the total number of barrels of petroleum transferred to the licensee's major facility during the previous month that had previously been transferred and subject to fee imposition; and

(3) such other information as is required by the department for the proper and effective administration of article 12 of the Navigation Law.

(b) All monthly reports shall contain the sworn statement of an owner or operator of the major facility, or of an authorized officer or employee of the owner or operator of the major facility, that the facts stated in the monthly report are true to the best of such person's knowledge and belief.

(c) Monthly reports shall be submitted to the commissioner at the following address:

(d) The monthly report for each month shall be received by the commissioner no later than the 20th day of the month immediately following. Any monthly report mailed to the commissioner must be properly addressed and postage paid. If a monthly report is mailed and is not delivered by the United States mail to the Major Petroleum Facilities Section by the 20th day of the month immediately following, the date of United States postmark stamped on the envelope shall be deemed to be the date of receipt by the commissioner.
